I.L. Fleming, Isaac L. Fleming and Cheryl Fleming -- NOTICE OF SALE UNDER POWER GEORGIA, MCINTOSH COUNTY By virtue of a Power of Sale contained in that certain Deed to Secure Debt from ISAAC L. FLEMING and CHERYL FLEMING to CARVER STATE BANK dated June 29, 2009, recorded on July 2, 2009 in Deed Book 520, Page 344, in the Office of the Clerk of Superior Court of McIntosh County, Georgia, and recorded on July 10, 2009 in Deed Book 1597, Page 22, in the Office of the Clerk of Superior Court of Liberty County, Georgia, which Security Deed was modified on June 29, 2010 in a Modification of Deed to Secure Debt, which was recorded on May 18, 2011 in Deed Book 551, Page 359, in the Office of the Clerk of Superior Court of McIntosh County, Georgia, and recorded on July 6, 2012 in Deed Book 1731, Page 448, in the Office of the Clerk of Superior Court of Liberty County, Georgia, and in that certain Deed to Secure Debt from ISAAC L. FLEMING and CHERYL FLEMING to CARVER STATE BANK dated November 2, 2007, recorded on November 8, 2007 in Deed Book 487, Page 30, in the Office of the Superior Court of McIntosh County, Georgia, which was modified on December 23, 2010 and June 15, 2012 in Modifications of Deed to Secure Debt, which were recorded, respectively, on May 18, 2011 in Deed Book 551, Page 363 and on January 7, 2013 in Deed Book 574, Page 199, in the Office of the Clerk of Superior Court of McIntosh County, Georgia, said Security Deeds securing Note 111112452 dated June 15, 2012 in the original principal amount of One Hundred Ninety One Thousand Two Hundred Thirty Nine and 96/100 dollars ($191,239.96) and Note 1113794, also dated June 15, 2012 in the original principal amount of Three Hundred Fifty Nine Thousand Seven Hundred Eighteen and 18/100 dollars ($359,718.18), with interest thereon as provided for therein. Said Security Deed having not been sold, assigned or transferred, and said Security Deed continuing to secure the Notes made by CARVER STATE BANK, secured creditor, there will be sold at public outcry to the highest bidder for cash before the courthouse door of McIntosh County, Georgia, within the legal hours of sale on the first Tuesday in August 2020, such date being August 4, 2020, the following properties described in said Security Deed: All that certain lot, tract or parcel of land situate, lying and being in the 1892nd G.M. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Notes including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys` fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed and Notes.
