Stokes on July 15, 2025 (the "Default Judgment"), and further pursuant to a Notice of Claim of Lien for Unpaid Homeowners' Dues as to Lot 76 Owned by Hannah Holdings, L.P. recorded in the real estate records of the Clerk of the Superior Court of Liberty County, Georgia, at Lien Book 122, Page 258, on or about April 5, 2023, by Hampton Island Owners Association, Inc. (the "Lien"), which Lien was subsequently assigned to Real Estate Next Door LLC, there will be sold by the undersigned at public outcry to the highest bidder for cash or credit bid before the courthouse door of Liberty County, Georgia (or such other area as designated by order of the Superior Court of said county), within the legal hours of sale on September 2, 2025 (being the first Tuesday of said month), the following described property, together with all fixtures and personal property attached to and constituting a part of said property, if any (the "Property"): All that certain lot, tract or parcel of land situate, lying and being in the 15th G.M. District of Liberty County, Georgia, designated as Lot No. 76, Hampton Island, Phase IV (known as "On the Marsh"), as more particularly described upon that certain plat of survey dated July 5, 2005, entitled "A Plat of Hampton Island Phase IV" prepared by Thomas & Hutton Engineering Co. and certified by Boyce L. Young, Georgia Registered Land Surveyor No. 2282, which plat of survey (consisting of four (4) pages) is recorded in Plat Slide N-87, Page(s) 3AB, 3CD, 4AB and 4CD in the Office of the Clerk of Superior Court of Liberty County, Georgia, and which plat of survey is by express reference incorporated herein for descriptive and all other purposes; subject to covenants, restrictions, and easements of record and taxes for current year. The Default Judgment having been entered against the owner of record of the Property, and the debt represented by the Lien remaining in default, this sale will be made for the purpose of paying said debt and all expenses of this sale, as provided in the Lien and the Default Judgment, and by law, including attorneys' fees (notice of intent to collect attorney's fees having been given). To the best knowledge and belief of the undersigned, there are no parties in possession of the Property. Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bills that constitute a lien against the property, whether due and payable or not yet due and payable and which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Lien first set out above. The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code. Pursuant to O.C.G.A. SS 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Lien, Default Judgment, and other foreclosure documents may not be provided until final confirmation as provided immediately above.
